I believe, USCIS website was updated on Sep 21st 2009.
My Priority date is Jun 2006 and applied in EB3 category.
I got an email on Sep 22nd 2009 from USCIS saying "Document mailed to applicant". When I see online status, it is "Document production or Oath Ceremony".
I called twice USCIS to confirm it. But they are saying "According to online status the document was already sent to your current address".
I am in a situation to beleive it or not? to celebrate it or not.... :-( .....
And one more thing is "I got EAD before my marriage and I haven't added my wife to I485"?
If I get GC, how to add my wife to GC? is it possible? what is her status right now?

Update your profile first. Your priority date is nowhere near the approval timeframe. If by chance, you do get it, you can file for a "follow to join" procedure.

Get yourself fired from your current company & join your client. As it is not ur intent to move and you are foreced to move. You can explain this during naturalization. Also as it is the same job you dont need to worry..

I got my GC on 09/18/07. Now my consulting company (how sponsored my GC) is having issues with the client and client is thinking to terminate the contract.
Client want to bring me to there pay roll. In other words they are offering my permanent position.
My consulting company does not have immediate opening for me.
It is not even a month that I got my GC. And I am with the same consulting company for about 6.5 years now.
Please help me. What should I do? If I accept the offer will I get problem at citizenship stage? If I do not accept offer I will loose job and I don't know how much time I have to wait till my consulting company find job for me.

I had also gone to local centre with info pass to buy some more time to reply MTR coz i didnt have enough evidence to prove A2P .they told me file within 30 days with what ever i have as tell them that u got notice on 28th day n buy more time .But advice was to file within 30 days .

My wife need to travel to india urgently. Our visa/I94 expired in Oct. We already applied 485 and is pending.
1) Will there be any issue at airpot as I94 is expired.A xerox copy of 485 receipt is sufficient. There shouldn't be any issue at the airport, I actually did not surrender my I-94 once out of ignorance and gave it to immigration officer on my way back. Anyway, As per your plan, take a copy of I485 receipt.
2) Does she need to travel any path in this case( I heard thru London is issue if visa is expired.France/Amsterdam Etcc..) London, you would need transit visa if you do not have US Visa stamped on your passport (even AP cannot help you here). I don't know about other Airports.

It seem like the CIR does not allow working as consultant on H1B. I read through that part, but does not quite understand. Can someone who understands the legislation let me if the bill passed, what is the effective time that we need to stop working?
Is it:
1> The time when bill is signed by Bush?
2> The beginning of the following fisical year?
or
3> You can keep working till the current H1B expires, but cannot renew?

I just got the H1 Approval for 1 year and 2 months (1 year H1 Extension and 2 months recapture time). I am currently in Malaysia and need to apply for a visa at US Consulate in Malaysia. Since I am on the H1 visa, I have to show the proof that I will return back to Malaysia after the end of my work period in US. Accordingly, I would need to purchase the round trip ticket. The issue is that the plane ticket only valid for the maximum of 1 year, but my visa valid for 1 year and 2 months. Please advise if one way plane ticket would be sufficient for the visa interview or need to be a round trip plane ticket. If it is not, what should I do? Also, I wonder if the application package including I-129 submitted to USCIS need to be stamped �Certified True Copy� with the original signature of the lawyer or employer for the visa interview. Can I use the copy one that is stamped �Certified True Copy� with the non-original signatures of my lawyer or employer? Anybody pls help. Thank you very much.

I also don't have a Nikon D40x, but I don't think any of this discussion is related to the specific camera model, although some of my discussion relies on you being able to change settings on the camera, and my names of things may be off from what Nikon uses - hopefully I can still get you on the right track.
It's actually a myth that a longer lens requires a higher aperture. For the same framing, you get the same DOF (Depth Of Field) for the same aperture, whether you use a 600mm telephoto lens or a 4.5mm ultra-fisheye. The only difference is that if you want to fill the frame with a sparrow, you can sit at 10 meters or so with a 600mm, and you need to be touching the sparrow with the lens to get it to fill the fram on a 4.5mm lens. Since most of the time, we don't try to get "eye to eye" with wild sparrows and ultira-fish-eyes, nor take pictures of "everything around you" with a 600mm tele (which would put you half a mile away, or so), it appears that the wide-angle has a bigger depth of field. If you don't beleive me, feel free to place a page of newspaper print at an angle (so that you can see how much of it is in focus), and photograph the exact same bit of text from different distances with the same aperture and different focal length.
So, smaller aperture (bigger number) will allow more depth-of-field, no matter what lens you use. Wide-angle works well for indoors shots, because it's usually close-up - but I have used my 100mm Macro for some of the shots of my son.
For "active" shots, you may want to aim for f/5.6 - f/8 or so. ISO 400 or higher helps reduce the look of "flash in dark room" scenario.
For the other trick when taking action shots of kids, the trick is to use the same settings as the sports photographers: relatively short shutter speed (unless you actually want motion blur as part of the image - in the right place, it's good, in most cases not!), and use "following autofocus" (aka AF Servo or Tracking AF) - this is the part where knowing what Nikon calls it could come in handy - so that the AF is continously focusing on the subject, same as if you were trying to follow a basketball-player as he makes his way across the court to the basket. That way, the camera tries to focus (and uses "computer magic" to PREDICT where the focus should be once the shutter is triggered).
Third, I think Nikon flashes also support "Second curtain flash", which is definitely the better option for "natural looking light" - this allows the camera to capture the natural light first, the flash the flash, rather than the ohter way around. It should, in theory, make no difference, but I find that it gives a more natural look. Twiddling with the balance between flash and natural light will get you there sooner or later (usually, in my case, later - after son or daughter have finished thinking photography is fun!). The adjustments are:
- smaller aperture (bigger F-number)
- faster shutter speed
- lower ISO number.

All Eb3 will get close to 40k this year . There will not be any spill over from Eb1 or Eb2. Also Eb3 ROW is not current so chances are very minimal that Eb3 india and China will get any exxtra visa. Only CIR or Recapture is hope for Eb3. OR as I said in earliar post that if Labor dept makes too hard to file for Eb2 in coming years then after 2-3 years you may see spill over to Eb3. otherwise it will crawl. But chances are there that they will recapture or do CIR in between.

If two consultants are working through a consultancy, their own opinion might differ drastically about the same company. These desi consultancies treat everybody differently.
I agree to that wholeheartedly!
I used to work for a Consultancy A(a middle size desi Consultancy firm based out of NYC)...signed a 2 year contract...broke it within 6 months & joined an even worse company B(which I found out only after joining them...very small west coast company)... got sued by company A ...left B and joined back A.
But after coming back to them(A), I could appreciate more of their way of working ...as I saw even worse companies. If you are honoring the contract, then everything is fine...
So, some of my friends, would say company A is a bloodsucker....for me they are still better than most other Desi consultancy companies.
Since then, I have moved on in life and do not work for company A....

So, some of my friends, would say company A is a bloodsucker....for me they are still better than most other Desi consultancy companies.

My 797 petition is approved till 2011 but my H1B visa is not stamped. I am planning India trip in November. What would be appropriate for me..

Question 3. Will participation in the rally negatively impact my current non-immigrant status or future green card application?
No, exercising your civil rights does not impact your non-immigrant status or future green card application. There are certain procedures and processes for rejecting or denying petitions and applications, it is not done on whims and moods of agencies or USCIS employees. There is a process driven by federal regulations and rejections and denials are backed up by reasons described in federal regulations and the laws. Participating in rallies, meeting with your lawmakers, exercising your civic duties, and enjoying your civil rights granted by the Constitution are not grounds for denial or rejection of petitions and applications or any other adverse action on immigration petition or application.
Question 4. Can my employer take action against me for participating in the rally? Do we have any obligation to inform my employer if I participate by taking a day off?
No, an employer cannot simply take action against you for having exercised your Constitutional right granted by the first amendment. Whether you inform your employer about your plans for your vacation or day off is up to you and your relationship with your employer. Usually employers do not care what their employee do with their time off from work, as long as those activities are legal.

According to some websites more than 8000 I-485 applications were filed on July 2nd. Applications areprocessed according to the receipt date.
As there were thousands of application on July 2nd will time of receipt play any role in processing?

Me too getting worried about my wife's status...
Good thing is she had this issue when transferring H1 Visa when she was out of status for few months and she had to go to home country for stamping (explaining IO the situation where she was out of status) and came back on status...and she was on status till date.
One more thing is , the status will be counted from the last date of entry to US . If this is the case, I do not have any problem on my wife's status.
If your wife has maintained her status since she last visted US, may be going for H1 stamping and coming back to US, this should not matter..and more over she filed 485 as your dependent.
This is what my understanding is with respect to maintaing status....Let me know if this is not correct

Normally,
1. The Consulting company and client has an agreement; that they can not hire a person for 6- 12 months. (agreement is different from company to company).
2. Some times you have signed and BOND with consulting company; that you will not join the client for 2 years after you resign from the comapany.
3. You are try to spoil the relation. I urge you to tell the consulting comapny before you leave and join the client.
They can not revoke 140 so there is no harm to your 485. be careful of counting 485 filing date.
