Your status does not change to H1B till October 1st, 2009 so by default you are on OPT till that time. Now, you might want to check with your company lawyers if they are going ahead with the filing. My feeling is , they are going to go ahead with the filing since only after an H1B is laid off, USCIS is notified by the sponsoring employer. If you don't file on the April time frame, you might miss the bus for this year and your next shot comes only in April 2010. Take a moment off and think with a cool head, what do you think would be good for you and your career.

Can I apply for H1 B extension on my own or does it have to go through an immigrtion attorney?
I will be applying for 7th yr H1 based on an ongoing GC process. I 140 approved . I 485 pending.
Is this process any different from normal H1B application ( the first 6 years)

Can you start residency on EAD if you are the primary for 485? Meaning, can you use AC21 and change jobs from research to residency after 180 days from filing? Please help, really confused.

We must ask specialists like Greg Siskind or Stephen Perlitsh.
It would be a good idea if we setuup a conference call with either of these residency gurus, unless you know someone else who is the best.
There is a group called IV Physicians, 'paskal' runs this group. So if you are doing research, residency etc... you must join this group.

I'm trying to figure out the reasoning behind Mexico's numbers as well. According to the latest cut-off date tables http://www.travel.state.gov/pdf/EmploymentDemandUsedForCutOffDates.pdf
Mexico has about 5,800 folks total for EB-3 in the queue so far, but we have seen very little movement in the past years. My questions to the forum:
1) Is the slow movement due to so many cases in field offices not yet reported?
2) Do family-based numbers take away from the 7% of 140K visas a year or are these solely for EB?
3) Any idea why movement is so slow for Mexico given the numbers of people currently in the queue?
Theories are welcome.

As far as I know, there is no "filing of AC21 with an attorney". Please be more specific as this is not clear.
AC21 is something on basis of which you can change employer. If you get an RFE than you simply have to prove that you used AC21 to change employer. That's it.
Some people proactively send a letter to USCIS informing that they are using/have used AC21 to change their employer. But based on various attorneys feedback, opinion is that USCIS does not really use that letter for anything if sent proactively just to inform USCIS that you are using AC21.

My wife need to travel to india urgently. Our visa/I94 expired in Oct. We already applied 485 and is pending.
1) Will there be any issue at airpot as I94 is expired.A xerox copy of 485 receipt is sufficient.
2) Does she need to travel any path in this case( I heard thru London is issue if visa is expired.France/Amsterdam Etcc..)

I am also in same situation. My lawyer told me that he will file our application seperately without including each other as dependant. This doessn't make sense..... any input from others?
unless your PDs are very close to each other dont file independent. One will get GC first, other will be stuck for a while (unless you take the risk of withdrawing one ap and filing again when one person looks cloes to getting apprvoed)

Currently there is lot of political pressure on the administration from hispanic groups to take up immigration reform issue. So postponing the meeting is only going to make these groups more impatient. This news should get more media attention. I hope the push for immigration reform does not subside with this delay in meeting.

Do not mean to hijack the thread but the question hopefully is related.
When I submitted my 485 application, my wife and I requested just the EADs. We have the receipt notice as well as the EAD in our hands. Our FP is done as well.
We are now submitting our AP applications. If anyone has submitted late like myself in the recent past, I would appreciate this information.
1.) Could anyone let me know the appropriate documents for this?
2.) Also, what are the fees associated with it, especially with all the old vs new stuff?

well .. my priority date is July 2002 .. nd there are 14k eb3 visas wordwide .. until this date.

Prepare your evidence, this will include pay slips, emails, etc., write down a statement of facts, if you want to go the extra mile find the relevant parts of the statute (go to thomas.loc.gov and/or dol.gov) that ban the behavior where employer broke the law and print that out too.
Then go in person to local DOL office, speak politely with the nice people there, and your employer may find himself in hot water. Be prepared to take a half day for this.
Of course you want to make sure that no longer working for that employer does not put you out of status.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer that.....my AP got rejected because the rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....
I don't know how to react. The online doesn't have any update about that yet.

As per latest Service Processing times released on 1/17, NSC's EB2-140 dats is 13-Jul-06. My date is 29-Jul-06, Waiting for approval in near future. I will update the thread as soon as i hear something.
